These Terms of Service ("Terms") govern your use of the RankMatic website at rankmatic.io and the application at app.rankmatic.io (collectively, the "Service"), operated by RankMatic ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
2. Description of Service
RankMatic is an AI-powered analytics platform that connects to your Google Analytics 4 (GA4) and Google Search Console accounts to provide automated analysis, insights, and reporting for automotive dealership websites. The Service includes:
- AI-powered conversational analytics using natural language queries
- Automated ASC (Automotive Standards Council) event tracking and analysis
- Multi-property comparison and benchmarking
- Knowledge base and business event management
- Report generation with PDF and CSV export capabilities
- Plan mode and execute mode for structured analysis workflows
- Drill-down analysis across multiple dimensions
3. Account Registration
To use the Service, you must sign in using your Google account. You are responsible for:
- Maintaining the security of your Google account credentials
- All activities that occur under your account
- Ensuring you have the authority to grant access to the GA4 properties you connect
- Notifying us immediately of any unauthorized use of your account
4. Google API Access
The Service accesses your Google Analytics and Search Console data through Google's OAuth 2.0 authorization framework. By using the Service, you:
- Grant us read-only access to your selected GA4 properties and Search Console data
- Understand that we will not modify, delete, or write data to your Google accounts
- May revoke this access at any time through your Google Account permissions
RankMatic's use of Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements. Your Google data is used solely to provide the analytics features of the Service.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the Service's infrastructure
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to collect or harvest data about other users
- Resell, sublicense, or redistribute the Service without our written consent
- Use automated tools (bots, scrapers) to access the Service beyond normal use
- Upload malicious content, viruses, or harmful code to the knowledge base
6. User Content
You retain ownership of all content you create within the Service, including knowledge base documents, business events, custom instructions, and conversation history ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service.
You are responsible for ensuring your User Content does not violate any third-party rights or applicable laws.
7. AI-Generated Content
The Service uses artificial intelligence to analyze your data and generate insights, reports, and recommendations. You acknowledge that:
- AI-generated analysis is provided for informational purposes and should not be the sole basis for business decisions
- AI outputs may contain inaccuracies or errors - you are responsible for verifying important findings
- We do not guarantee the accuracy, completeness, or reliability of AI-generated content
- Analysis quality depends on the quality and completeness of your underlying GA4 data
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance and updates
- Google API rate limits or outages
- Unforeseen technical issues
- Circumstances beyond our reasonable control
9. Fees and Payment
Current pricing and payment terms are displayed on the Service. We reserve the right to modify pricing with reasonable notice. Free tier limitations may apply.
10. Intellectual Property
The Service, including its design, features, code, documentation, and branding, is owned by RankMatic and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for decisions made based on AI-generated analysis or insights
12. Indemnification
You agree to indemnify and hold harmless RankMatic, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
13. Termination
Either party may terminate this agreement at any time:
- You may stop using the Service and revoke Google API access at any time
- We may suspend or terminate your access if you violate these Terms or if required by law
Upon termination, your right to use the Service ceases immediately. You may request export of your User Content before termination.
14. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
